Introduction

These Terms of Use ("Terms") apply to your access and use of the website www.mottmac.com (the "Site") and the content and services available on or through the Site. The Site is owned and operated by Mott MacDonald Group Limited and its affiliated companies, subsidiaries and branches (collectively, "Mott MacDonald", "we", "us" or "our"). By accessing or using the Site, you agree to be bound by these Terms, our Website Privacy Notice  and our Online Tracking Technologies Privacy Notice, which are incorporated by reference. If you do not agree to these Terms, you must not access or use the Site.

Changes to the Terms and Site

We may revise and update these Terms from time to time, without prior notice, by posting the amended version on the Site. The date of the last modification will appear at the top of these Terms. Your continued use of the Site after the effective date of any changes will constitute your acceptance of those changes. Content and Intellectual Property Rights

We also reserve the right to report any suspected illegal or unauthorised activity to law enforcement authorities.

Suspension

No text or data mining, or web scraping

You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to our Site or the Content for any purpose, including the development, training, fine-tuning or validation of AI systems or models. This includes using (or permitting, authorising or attempting the use of):

  • Any "robot", "bot", "spider", "scraper" or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of our Site or any data, Content or information accessed via the same, or to circumvent any security measures or systems used by the Site.
  • Any automated analytical technique aimed at analysing text and data in digital form to generate information or develop, train, fine-tune or validate AI systems or models which includes but is not limited to patterns, trends and correlations.

The provisions in this clause should be treated as an express reservation of our rights in this regard, including for the purposes of Article 4(3) of the Digital Copyright Directive ((EU) 2019/790).

You shall not use, and we do not consent to the use of our Site, the Content, or any data published by, or contained in, or accessible via, our Site for the purposes of developing, training, fine-tuning or validating any AI system or model.

This clause will not apply insofar as (but only to the extent that) we are unable to exclude or limit text or data mining or web scraping activity by contract under the laws which are applicable to us.

Rules about linking to our site

You may link to our website pages, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. Without limiting the generality of the foregoing, Mott MacDonald and its licensors shall not be liable for any loss of profits, revenue, data, goodwill, business opportunities or anticipated savings, for any interruption of business or for any indirect or consequential loss or damage, or for any loss or damage arising from or relating to any third party content, sites, products or services accessed or obtained through the Site.

Your sole and exclusive remedy is to discontinue using and accessing this Site.

Indemnity

Mott MacDonald reserves the right, at its own expense, to assume the exclusive defence and control of any matter subject to indemnification by you, and you agree to cooperate with Mott MacDonald's defence of such claims.

Governing Law and Jurisdiction

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of England and Wales, without regard to its principles of conflicts of laws. You agree to submit to the exclusive jurisdiction of the courts of England and Wales with respect to any dispute arising out of or in connection with these Terms, the Site, the Content, or any products or services obtained through the Site, and you waive any jurisdictional, venue or inconvenient forum objections to such courts.

General

These Terms constitute the entire agreement between you and Mott MacDonald with respect to the Site and supersede all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and Mott MacDonald with respect to the Site.

If any provision of these Terms is found to be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.

You may not assign or transfer any of your rights or obligations under these Terms without the prior written consent of Mott MacDonald. Mott MacDonald may assign or transfer these Terms, or any of its rights or obligations under these Terms, without your consent and without notice to you.
